You may use our website for lawful purposes and in accordance with these Terms.
You agree not to:
Use the website for unlawful purposes
Attempt to gain unauthorized access to our website or systems
Interfere with the operation or security of the website
Submit false, misleading, or fraudulent information

Use the website in a manner that could damage Top Hat Vendor Emporium or its customers, vendors, or service providers
We reserve the right to restrict or terminate access to our website when we reasonably believe these Terms have been violated.
3. Merchandise and Product Information
Top Hat Vendor Emporium offers a constantly changing selection of antiques, vintage merchandise, collectibles, furniture, décor, jewelry, memorabilia, and other unique items.
Because many items are vintage, antique, used, handmade, one-of-a-kind, or previously owned, individual items may show signs of age, wear, use, restoration, repairs, imperfections, or other characteristics consistent with their history.
Product descriptions, photographs, dimensions, colors, availability, and other information are provided in good faith but may not always be completely accurate or current.
Customers are encouraged to examine merchandise carefully before purchasing whenever possible and to ask questions about an item before completing a purchase.
4. All Sales Are Final
ALL SALES ARE FINAL.
Top Hat Vendor Emporium does not accept returns, exchanges, refunds, or cancellations on merchandise after a sale has been completed, except when required by applicable law or when Top Hat Vendor Emporium expressly agrees otherwise in writing.
Customers are responsible for making sure they are satisfied with an item before purchasing it.
Because many items sold through Top Hat Vendor Emporium are antique, vintage, collectible, used, unique, or one-of-a-kind, normal age-related wear, imperfections, alterations, repairs, restoration, and other characteristics of previously owned merchandise are not considered defects unless specifically represented otherwise.
5. Online Purchases
Online merchandise may be offered through a third-party e-commerce platform.
Additional terms, payment policies, shipping policies, and technical requirements established by the third-party e-commerce provider may apply to online transactions.
By completing an online purchase, you agree to provide accurate information necessary to process your order.
Top Hat Vendor Emporium reserves the right to correct pricing, description, inventory, or listing errors and to cancel an order when an error or other legitimate issue prevents the order from being fulfilled.
Unless otherwise required by applicable law, all online sales are final.
6. Pricing and Availability
Prices and merchandise availability may change without notice.
Because Top Hat Vendor Emporium operates a multi-vendor marketplace and carries unique and one-of-a-kind items, merchandise shown online or previously seen in the store may no longer be available.
We do not guarantee that a particular item will remain available until you arrive at the store or complete a purchase.
7. Antique Buying and Purchase Offers
Top Hat Vendor Emporium may purchase qualifying antiques, vintage items, collectibles, furniture, jewelry, artwork, memorabilia, and other merchandise.
Submitting an item for consideration does not guarantee that Top Hat Vendor Emporium will make an offer or purchase the item.
Our decision to purchase an item may depend on factors including:
Condition
Authenticity
Age
Rarity
Provenance or history
Current market demand
Desirability to collectors
Available space
Existing inventory
Resale potential
Size and condition of the item
Other business considerations
Any purchase offer made by Top Hat Vendor Emporium is subject to agreement between the parties.
An offer is not binding until the terms of the purchase have been accepted by both parties and the transaction has been completed.
8. Ownership and Authority to Sell
When submitting merchandise to Top Hat Vendor Emporium for purchase, consignment, or consideration for sale, you represent that:
You are the lawful owner of the merchandise or are legally authorized to act on behalf of the owner
You have the legal right to sell or consign the merchandise
The merchandise is not stolen or unlawfully obtained
You have not knowingly provided false information regarding the merchandise
You will disclose known information about authenticity, ownership, provenance, restoration, repairs, or material alterations when relevant
Top Hat Vendor Emporium reserves the right to decline merchandise when ownership, authenticity, condition, or other relevant circumstances cannot be reasonably established.
9. Consignment Services
Top Hat Vendor Emporium may accept qualifying antiques, vintage items, collectibles, furniture, jewelry, artwork, décor, memorabilia, and other merchandise for consignment.
Acceptance of merchandise for consideration does not guarantee that the item will be accepted for consignment.
Consigned merchandise must meet Top Hat Vendor Emporium’s current acceptance standards and may be declined based on condition, authenticity, desirability, market demand, available space, category, or other business considerations.
10. Consignment Agreements
Specific consignment transactions may be governed by a separate written consignment agreement.
The individual consignment agreement may establish terms including:
Items accepted for consignment
Listing or selling price
Commission or seller percentage
Consignment period
Payment terms
Markdown or pricing policies
Responsibility for merchandise
Procedures for unsold merchandise
Removal or pickup requirements
Damage or loss provisions
Other terms specific to the consignment arrangement
If a separate written consignment agreement conflicts with these general Terms and Conditions, the specific written consignment agreement will control with respect to that transaction.
11. Consignment Pricing and Sales
Top Hat Vendor Emporium may determine or recommend pricing for consigned merchandise in accordance with the applicable consignment agreement.
Consigned merchandise may be subject to price adjustments, promotions, discounts, or other selling practices when permitted by the applicable agreement.
Payment to the consignor is based on the terms established in the applicable consignment agreement and is generally dependent upon the merchandise being sold and the applicable payment period being reached.
Consignors are responsible for reviewing their individual consignment agreement before leaving merchandise with Top Hat Vendor Emporium.
12. Unsold Consignment Merchandise
Merchandise that does not sell during the applicable consignment period may be subject to the terms of the individual consignment agreement.
Consignors may be responsible for retrieving unsold merchandise within the time period specified in their agreement.
Merchandise not retrieved according to the applicable agreement may be handled as permitted by that agreement and applicable law.
13. Vendor Booth Rentals
Top Hat Vendor Emporium offers vendor booth and retail display spaces for individuals and businesses interested in selling approved antiques, vintage merchandise, collectibles, furniture, décor, jewelry, memorabilia, and other merchandise.
Vendor spaces may range from approximately $70 to $800 per month, depending on the size, location, and type of space.
Prices, availability, booth sizes, and rental terms are subject to change.
14. Vendor Agreements
Vendor booth rentals may require a separate written vendor agreement.
The vendor agreement may establish specific terms regarding:
Monthly booth rent
Booth size and location
Rental period
Payment due dates
Security deposits, if applicable
Merchandise restrictions
Pricing and tagging requirements
Booth setup and appearance
Vendor responsibilities
Store policies
Damage or loss
Termination of the agreement
Removal of merchandise
Other vendor requirements
The individual vendor agreement will govern the specific rental relationship between Top Hat Vendor Emporium and the vendor.
15. Vendor Merchandise
Vendors are responsible for ensuring that all merchandise placed in their booth is lawful, accurately represented, and permitted under Top Hat Vendor Emporium’s vendor policies.
Top Hat Vendor Emporium may prohibit merchandise that is:
Illegal
Counterfeit
Stolen
Misrepresented
Unsafe
Prohibited by applicable law
Inappropriate for the store
Inconsistent with store policies
Otherwise unsuitable for the marketplace
Top Hat Vendor Emporium reserves the right to request removal of merchandise that violates store policies or applicable law.
16. Vendor Booth Appearance
Vendors are responsible for maintaining their booth in a clean, organized, attractive, and safe condition.
Top Hat Vendor Emporium may establish reasonable rules concerning booth displays, signage, merchandise placement, walkways, electrical equipment, decorations, pricing, and other aspects of the vendor area.
These requirements are intended to maintain a safe and enjoyable shopping environment for customers and a professional marketplace for all vendors.
17. Vendor Payments and Rent
Vendor rent and other applicable charges are due according to the terms of the vendor’s agreement.
Failure to make required payments may result in late fees, suspension of selling privileges, termination of the vendor agreement, removal of merchandise, or other remedies permitted under the applicable agreement and law.
Specific payment terms will be provided to vendors before or when their booth rental agreement is established.
18. Merchandise Loss, Damage, or Theft
Top Hat Vendor Emporium takes reasonable measures to maintain a safe retail environment; however, antiques, collectibles, furniture, and other merchandise displayed in a public marketplace may be subject to accidental damage, loss, or theft.
Responsibility for loss or damage may depend on the circumstances and the terms of the applicable purchase, consignment, or vendor agreement.
Vendors and consignors should carefully review their applicable agreements regarding responsibility for merchandise.
19. Antique Appraisals and Evaluations
Top Hat Vendor Emporium may provide information, opinions, evaluations, or other assistance regarding antiques, vintage items, collectibles, furniture, jewelry, artwork, and other merchandise.
Unless specifically stated otherwise in writing, information provided by Top Hat Vendor Emporium should not be considered a guarantee of market value, resale value, insurance value, tax value, legal value, or any other guaranteed valuation.
Market values can change over time and may vary depending on the buyer, market, condition, authenticity, provenance, location, and other factors.
If you require a formal appraisal for insurance, estate, tax, legal, probate, charitable donation, or other official purposes, you should consult an appropriately qualified and credentialed professional.
